Ohio Senate Bill 22…call to action

Ohio Senate Bill 22: Proponent Testimony Call to Action This Wednesday, Feb. 3rd, there is proponent (support) testimony for Ohio Senate Bill 22 (the new and improved version of SB 311). 

Legislative analysis summary: Permits the General Assembly to rescind orders and rules issued by the Governor or Ohio Department of Health (ODH).

Establishes the Ohio Health Oversight and Advisory Committee, and grants the Committee the power to rescind certain orders and rules issued by the Governor and ODH. (NOTE: Gov. orders are evaluated by the committee 11 days after they are written. The committee will consist of 6 members: 3 Senators [2-R, 1-D.] appointed by Senate President Huffman, and 3 representatives [2-R, 1-D] appointed by House Speaker Cupp.)

Limits the duration of a public health state of emergency to 30 days unless extended BY the General Assembly.

During a public health state of emergency, requires the Governor and ODH to REPORT to the President of the Senate and the Speaker of the House of Representatives ANY actions taken in response to the emergency.

Subjects existing orders and rules issued by the Governor or ODH to review and rescission by the General Assembly and the Committee.(NOTE: Allows general assembly to vote on a simple resolution (at any time) that rescinds an order by the Governor.

If passed, it can NOT be vetoed and the order no longer stands.)The bill removes the word “ultimate” from existing law describing ODH’s authority over matters of quarantine and isolation. 

When there is an emergency determined regarding a tainted consumable product, then it changes the wording from being described as a “public health emergency”, to instead specifying it as an “adulterated consumer product emergency”.
