The 11th Circuit Court of Appeals has ruled once again for the Auburn Employee Union (CATA) and against the hapless Auburn Board of Trustees and Administration. Auburn is guilty of malfeasance in office, in our opinion, for foolishly spending taxpayers’ property taxes on legal fees.
“Malfeasance is an act that is illegal and causes physical or monetary harm to someone else. Malfeasance is intentional conduct that is wrongful or unlawful, especially by officials or public employees.”
Judge Lucci states that the STRS payment are due on the amounts awarded under the initial judgment ( $1.4 million). We would now think that Auburn has exhausted all of its legal challenges, but this Superintendent and his “rubber stamp” Board apparently totally disregard the taxpayers’ funding through property taxes and may still file appeal after appeal.

The only question we have is who is losing their job for spending over $3 million to cover a $144,000 claim?
