Concord Township Wins Lawsuit Over Brian Ames…Update..It Ain’t Over Until Brian Ames Says it Over…

Mr. Ames correctly told me that I should have asked for his take on the verdict. He will be filing a response to the 11th Circuit Court of Appeals, or the Supreme Court…We will publish his response when he send it to us.

Concord Administrator, Mr. Andy Rose, sent us the 11th Circuit Court of Appeals’ ruling on the mandamus action filed by Mogadore’s Brian Ames against Concord Township for failure to comply with Ohio Public Records law.

“Per Curiam Opinion” means that there was a unanimous decision by the three judges dismissing the claim by Mr. Ames.

Upon reading the Court’s ruling we found this interesting piece of history:

1. Relator (Brian Ames) submitted his public records request using the pseudonym “Lavrentiy Beria.” Lavrentiy Beria was a close ally of Joseph Stalin, a notorious deputy head of the of the NKVD, and member of the Politburo. Howard Watson, Twisted History (Buffalo: Firefly Books, 2015), 61-63. Beria’s exploits resulted in the death or imprisonment of millions. Id. at 63. After Stalin’s death, Beria briefly rose to the highest echelons of the state before Nikita Khrushchev organized a coup and had Beria executed on December 23, 1953. Id. 

Basically, the Court found Mr. Ames’s complaint to be “moot” or irrelevant.
