The Rooster, Donald J. Byrnes II, has filed a motion to dismiss the charges filed by State Senator Jerry Cirino and his posse for the charge of telecommunication harrassment.
Here are all the gory details of the arrest of the Rooster by Jerry, the Don of Lake County, Cirino’s posse, comprised of City of Kirtland Police Chief Jamey Fisher and Willoughby Municipal Court Judge Marissa L. Cornachio.
On page 104 is Senator Cirino’s email to the Kirtland Police Chief, Jamey Fisher.
Excerpt of email from Jerry to Jamey:
“I would like this harassment to stop immediately and I would like charges filed against the individual.”…Jerry Cirino
On page 107 is Judge Marisa Cornachio’s summons to Donald J. Byrnes (a.k.a. the Rooster) to appear in court.
“Donald J. Byrnes II did, knowingly make or cause to be made a telecommunication to another, and the caller made the telecommunication with purpose to harass, intimidate, or abuse a person at the premises to which the telecommunication is made, to wit: Donald J. Byrnes did send an explicit image and two harassing text messages on May 6, 2026, from phone number (redacted) to victim JC with the purpose to harass JC.”
“In violation of section 2917.21 (A) (1) of the Revised Code, Telecommunications harassment, a misdemeanor of the first degree.”…Judge Marisa Cornachio
Page 109 is Cornachio’s warrant for Byrnes arrest. It is interesting to note that Judge Cornachio wrote on the arrest warrant that she had no contact with the victim. Sorry, but this writer is not buying that statement. They both endorsed each other for political office.
We will follow this case with great interest. Unfortunately, the Rooster has to get agreement from another Lake County judge. Let us see if Judge Michael Cicconetti believes in the U.S. and Ohio Constitution. He swore an oath to defend both, but so did Ohio legislators. They violate their oath in supporting the immoral Ohio property taxes.
Here is Byrnes’ argument why the charges should be dropped.
“The grounds for this motion are that the prosecution under the telecommunications
harassment statute is unconstitutional as applied to him under the First and Fourteenth Amendments
to the United States Constitution and Art. I, §§3 and 11 of the Ohio Constitution.”…Byrnes statement for the dismissal.
It will be interesting to see if the charges are dropped will Byrnes sue the Lake County posse.

A reader corrected me on my interpretation of Judge Cornachio’s statement “No contact with the victim”.
“Great post. Thanks especially for the link to his attorneys’ motion to dismiss. Great case law and analysis. I hope the Rooster wins this.
One thing I would note, regarding the “No contact with victim” notation. I may be wrong, but I suspect it is an additional judicial instruction, that the Rooster is to have no contact with the “victim.” Not that the judge and Cirino had no contact with each other.
And that is so rich, that Cirino is a “victim.” This is a man who put himself in the public arena, and can’t take the criticism that comes with that.
I recall when he ran against Kim Laurie, in the Republican primary, for county commissioner. She almost beat Dan Troy, in 2014, I think. So, for the next election, she ran again, and the Republican establishment recruited Cirino to run against her in the primary to make sure she didn’t win. She said Cirino described himself as a “ruthless businessman” – a charge he did not dispute. Funny how this ruthless businessman turned into a snowflake.”
